Terms of service
The rules for using Growbot.
1. Scope
These terms apply to all contracts for the use of Growbot between Henrique Medeiros, Growbot, c/o Ricardo Moura, Täfernstrasse 26, 5405 Baden-Dättwil, Switzerland (“we”) and you as a customer (“you”), whether you use Growbot for your business or privately. Different conditions only apply if we confirm them in writing.
2. What Growbot provides
Growbot is software on the internet (software as a service). Growbot researches your product, creates content in your branding with artificial intelligence, schedules and publishes it on connected accounts, finds relevant conversations and shows numbers. The exact scope depends on the chosen plan and the description on the website.
We provide the software, not a specific result such as more visitors, followers or revenue. We keep developing Growbot and may change features as long as the core of the service remains.
3. Account
You sign in with your Google account. Keep your details up to date and your access private. You are responsible for everything that happens through your account. You must be at least 18 years old.
4. Plans, prices and trial
- The prices on the website at the time of ordering apply, in Swiss francs (CHF), without VAT (not VAT-registered).
- You can try Starter and Pro free for 7 days. If you cancel before the trial ends, you pay nothing. After that the subscription starts automatically.
- If you change plans, Stripe charges or credits the difference pro rata.
5. Payment
- Payment is handled by our payment provider Stripe, in advance for the chosen term (monthly or yearly).
- You can pay by credit or debit card, Apple Pay and Google Pay and, for customers in Switzerland, TWINT.
- If a payment remains open after a reminder, we may suspend access until it is paid.
6. Term and cancellation
The subscription runs for one month or one year and renews automatically for the same period. You can cancel at any time to the end of the current period, directly in Growbot under “Plan & billing”. We do not refund periods already paid pro rata unless required by law.
We can cancel with 30 days' notice to the end of a period. Either party can terminate without notice for good cause (e.g. a serious breach of these terms).
After the contract ends, your account and content stay stored until you delete them or ask us to delete them. We then delete them as described in the privacy policy.
7. Right of withdrawal for consumers in the EU
If you are a consumer living in the EU, you can withdraw from the contract within 14 days of conclusion without giving a reason. An informal message to info@growbot.ch is enough. If you ask us to start the service during the withdrawal period, you pay a pro-rata amount for the time until withdrawal. There is no statutory right of withdrawal in Switzerland; the trial lets you try Growbot first.
8. Your obligations
- Only use Growbot for your own products or those you are authorised to promote, and only within the law.
- Follow the rules of the platforms you connect. Growbot only posts on your own accounts and never writes automatically in other people's discussions or direct messages.
- Only upload content you hold the rights to (images, logos, voices, videos of people only with their consent).
- No spam, deception or manipulation, no bought accounts, no fake reviews.
9. Content and rights
Your input and the content created for you belong to you, to the extent rights arise in them. You grant us the right to store and process them as far as needed for Growbot. We do not use your content for other customers.
The Growbot software, its design and its trademarks remain ours. You receive a non-transferable right to use them for the term of the contract.
10. Artificial intelligence and third-party platforms
AI content can be wrong, incomplete or similar to other content. Check it before publishing; you decide what appears in your name, including on autopilot (which you can switch off per channel at any time).
Accounts on third-party platforms are subject to their terms. We have no influence if a platform changes its interface or suspends an account. We respect the daily limits and rules we know of.
11. Availability and liability
We aim for uninterrupted operation but do not guarantee a specific availability. We announce maintenance where possible.
We are liable without limitation for damage caused intentionally or by gross negligence and for personal injury. Otherwise our liability is excluded as far as the law allows and in any case limited to the amounts you paid us in the last 12 months. We are not liable for lost profits, suspended accounts on third-party platforms or consequences of content you publish. Mandatory consumer rights remain unaffected.
12. Data protection and processing on your behalf
How we process your data is described in the privacy policy. Where we process personal data of your visitors, followers or customers on your behalf (tracking on your website, connected accounts), we act as processor under Art. 9 revFADP and Art. 28 GDPR. We process this data only on your instructions and for Growbot, bind our staff to confidentiality, only use the sub-processors named in the privacy policy (we announce changes and you may object), protect the data appropriately, help you with requests from data subjects and delete the data as soon as you delete the project or your account, or ask us to after the contract ends. We send you a separate data processing agreement on request.
13. Changes to these terms
We may change these terms. We notify you by email at least 30 days in advance. If you do not agree, you can cancel with effect from the change; otherwise the new terms apply.
14. Governing law and jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Baden. Consumers may also sue at their place of residence and keep the protection of the mandatory provisions of their country of residence.
If any provision is invalid, the rest remains valid.
